1.1 Data We Collect
When you submit a creative brief or contact form on our website, we collect the following personal data: your full name, email address, phone number, company name (if provided), project description, budget range, and service selection. We also collect standard web analytics data including IP address, browser type, referring URL, and page interaction metrics.
1.2 Purpose of Processing
Your personal data is processed exclusively for the purposes of: responding to your creative brief inquiries, preparing project scope proposals and quotations, managing ongoing client relationships and project delivery, sending invoicing and payment-related communications, and complying with applicable Spanish and EU tax and accounting obligations.
1.3 Legal Basis for Processing
We process your data under Article 6(1)(b) of the GDPR — performance of a contract or pre-contractual measures taken at your request. For marketing communications, we rely on Article 6(1)(a) — your explicit consent, which you may withdraw at any time.
1.4 Data Retention
Contact form submissions and creative briefs are retained for a period of 24 months from the date of submission. Invoicing and financial records are retained for 5 years as required by Spanish tax law (Ley General Tributaria). Analytics data is aggregated and anonymized after 12 months.
1.5 Data Sharing
We do not sell, rent, or trade your personal data to third parties. Data may be shared with: our hosting infrastructure provider (EU-based), payment processing services (for invoicing only), and legal or accounting advisors when required by law. All third-party processors are bound by Data Processing Agreements in compliance with GDPR Article 28.
1.6 International Transfers
All personal data is stored within the European Economic Area (EEA). If any data transfer outside the EEA is necessary, we ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) as approved by the European Commission.
1.7 Your Rights
Under the GDPR, you have the right to: access your personal data (Article 15), rectify inaccurate data (Article 16), request erasure of your data (Article 17), restrict processing (Article 18), data portability (Article 20), and object to processing (Article 21). 1.8 Security Measures
CreativeLayerStudio implements appropriate technical and organizational measures to protect your personal data, including TLS/SSL encryption for all data in transit, encrypted storage for all personal data at rest, access controls limiting data access to authorized personnel only, and regular security audits of our infrastructure and processes.

2.1 Scope of Services
CreativeLayerStudio provides creative design services including but not limited to brand identity systems, motion graphics, art direction, digital illustration, UI/UX design, visual content strategy, print collateral, 3D visualization, and creative consulting retainers. All services are delivered as described in the applicable service description on our website and confirmed in the project proposal.
2.2 Quotations and Proposals
All quotations and project proposals are valid for 14 calendar days from the date of issue unless otherwise specified. Prices are quoted in USD (or EUR where indicated) and are exclusive of applicable taxes unless explicitly stated. CreativeLayerStudio reserves the right to adjust pricing for projects that materially change in scope after the initial proposal.
2.3 Payment Terms
For one-time projects: 50% deposit is due upon acceptance of the proposal, with the remaining 50% due upon delivery of final assets. For monthly retainers: payment is due on the 1st of each calendar month for the preceding month's services. Late payments incur a 2% monthly interest charge. All invoices are payable within 14 calendar days of issue.
2.4 Intellectual Property
Upon full payment of all outstanding invoices, CreativeLayerStudio assigns all worldwide intellectual property rights in the delivered creative assets, design files, and source materials to the Client. This assignment includes the right to use, modify, reproduce, distribute, and publicly display the delivered work without restriction. CreativeLayerStudio retains the right to display completed work in its portfolio and marketing materials unless the Client explicitly requests otherwise in writing.
2.5 Revisions
Each service includes the number of revision rounds specified in the service description. Additional revision rounds beyond the included allotment are billed at $85 USD per round. A revision round is defined as a single consolidated set of feedback notes submitted by the Client. Partial or incremental feedback submitted across multiple communications constitutes separate revision rounds.
2.6 Project Timelines
Estimated delivery timelines are provided in business days and commence upon receipt of the initial deposit and all required creative brief materials. Timelines may be extended if the Client delays in providing feedback, approvals, or necessary materials. CreativeLayerStudio will communicate any timeline adjustments promptly.
2.7 Limitation of Liability
CreativeLayerStudio's total liability under any engagement shall not exceed the total fees paid by the Client for the specific project giving rise to the claim. CreativeLayerStudio shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use or inability to use the delivered creative assets.
2.8 Governing Law
These Terms of Service are governed by the laws of Spain. Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Bilbao, Bizkaia, Spain.

4.1 Deposit Refund
If you cancel your project before any creative work has commenced, you are entitled to a full refund of your deposit within 14 business days. Cancellation must be submitted in writing to [email protected].
4.2 Partial Refund
If a project is cancelled after work has commenced but before final delivery, a partial refund will be calculated based on the percentage of work completed. The Client will receive a detailed breakdown of completed and remaining work to justify the refund amount. Refunds are processed within 21 business days of cancellation approval.
4.3 Completed Work
No refund is available for work that has been completed and delivered. Once final assets have been delivered and accepted, the project is considered complete. If the delivered work materially differs from the agreed scope described in the proposal, the Client must notify CreativeLayerStudio within 7 calendar days of delivery.
4.4 Monthly Retainers
Monthly retainer agreements require a 3-month minimum commitment. After the initial commitment period, the retainer may be cancelled with 30 days' written notice. No partial-month refunds are provided for mid-month cancellations. Prepaid months beyond the notice period will be refunded.
4.5 Refund Process
To request a refund, contact [email protected] with your project reference number and reason for the refund request. Refunds are processed using the original payment method where possible. Processing times may vary depending on your financial institution.
4.6 Dispute Resolution
If you are dissatisfied with the refund decision, you may escalate your concern by contacting our studio management at [email protected]. We are committed to resolving disputes amicably. If a resolution cannot be reached, either party may seek mediation or legal remedies in accordance with Spanish law.
